China Patent Reexamination Deadline and Evidence Checklist

For foreign patent counsel triaging a rejected CN patent application.

The short answer: protect the deadline before debating the merits. Article 41 of the Chinese Patent Law provides three months from receipt of the rejection decision to request reexamination. Confirm the official receipt or delivery record, secure filing responsibility, and assemble the rejection record immediately. A PRSS batch date, commercial-database label, or the day someone first noticed “rejected” online is not the legal starting point.

First-day triage

Four facts to confirm before substantive analysis.

1. The decision

Obtain the complete CNIPA rejection decision—not a screenshot, status label, or third-party summary.

2. The receipt record

Confirm the official delivery or receipt information used by responsible filing counsel to calculate the three-month period.

3. Filing responsibility

Identify who is authorized to instruct, sign, pay, and file. Do not leave agency and client-approval questions until the final week.

4. The business objective

Record which independent-claim features matter commercially. A technically allowable but commercially empty amendment is not a useful rescue.

Do not confuse three different dates

Decision, receipt, and database dates serve different purposes.

A database first displays “rejected” on 30 June. That does not establish a 30 September deadline.

If the applicant officially received the decision earlier, a deadline calculated from the database date may be late. If receipt occurred later, the feed date may unnecessarily shorten the working period. Either way, the file record—not the feed—controls the analysis.

Evidence packet

Documents that make a first merits review useful.

Redacted copies are usually enough for initial triage if the technical substance, dates, and procedural sequence remain readable.

Procedural record

Rejection decision, receipt evidence, current status, filing instructions, applicant identity, and any existing docket calculation.

Application record

Current claims, specification, drawings, abstract, amendments, and—where relevant—the priority or PCT text.

Examination history

Office actions, earlier responses, examiner interviews or communications, search materials, and cited references.

Technical mapping

A feature map showing the closest prior art, disputed combinations, technical effects, and support for possible fallback language.

Commercial constraints

Products, competitor design-around concerns, must-preserve features, acceptable fallback scope, and jurisdictions with related claims.

Evidence and translation

Technical literature or other evidence relied on, with Chinese translation planning where foreign-language evidence may be submitted.

Merits review

Five questions the strategy should answer.

  1. What exactly was the examiner's rejection model? Identify the closest prior art, distinguishing features, alleged motivation to combine, and any common-knowledge assertion.
  2. Where does that model fail technically or legally? A useful response tests operating principles, technical effects, and the logic of the proposed combination.
  3. Can an argument-only route preserve the desired scope? Do not narrow automatically before testing the rejection reasoning.
  4. If amendment is needed, what basis and value remain? Each fallback should have specification support and a defined commercial purpose.
  5. What evidence is proportionate? Use evidence to answer a disputed technical proposition, not to make the file longer.

Filing controls

A strong brief is not filed until the formal steps are complete.

Confirm filing and fee evidence separately.

CNIPA materials require a written reexamination request explaining the reasons and, when necessary, attaching evidence. The reexamination fee must also be paid within the applicable period.

After filing, retain the submitted papers, electronic acknowledgement, fee record, and later acceptance or correction notice. For example, a finished draft sitting in email is not a filed request, just as a payment instruction is not proof that the fee reached the correct case.

When does the three-month period start?

From receipt of the rejection decision under Article 41. Responsible counsel should verify the official delivery or receipt record for the case.

Can we rely on a database's rejection date?

No. It can alert you to investigate, but it does not replace the official record used for deadline calculation.

Can the application be amended?

Amendment may be made when requesting reexamination or responding to a reexamination notice, but it must be directed to curing the identified defects. The exact route depends on the record and desired scope.

Do you need an unredacted file immediately?

Usually not for initial merits triage. Keep dates, claims, cited art, reasoning, and technical disclosure intact; client-identifying information can often remain redacted until confidentiality and conflicts are addressed.
