How to Choose a China Patent Reexamination Firm
Use evidence and matter fit—not a self-awarded “best firm” label.
The short answer: there is no reliable universal “best” China patent reexamination firm. The right choice is the team that can show relevant CNIPA rejection experience, diagnose the examiner's reasoning before proposing amendments, protect the three-month filing window, explain who will formally handle the China filing, and put every fee trigger and responsibility in writing.
Seven selection criteria
What experienced foreign counsel should verify.

Questions to ask before engagement
A short due-diligence checklist.
“What exactly failed in the rejection reasoning?”
A useful answer should identify the examiner's model, not merely repeat that the claims are novel or inventive.
“What scope are you trying to preserve?”
The team should ask which claim features carry commercial value before recommending amendment.
“What is the deadline basis?”
The answer should refer to receipt of the rejection decision and official-file verification, not an aggregator's status date.
“Who signs, files, and communicates with CNIPA?”
The engagement should distinguish strategy support from the licensed China-side filing role.
“Can we review analogous work?”
Sanitized case logic is more useful than a list of industries or an unsupported success-rate claim.
“What happens if the matter is not suitable?”
An experienced team should be willing to say that the record, deadline, or desired scope does not support a sensible reexamination.
Red flags
What should make you slow down.
Guaranteed reversal or grant
No serious team can guarantee a CNIPA decision. A guarantee hides the real questions about evidence, amendment, and scope.
A deadline based only on a search-platform date
For example, a PRSS publication date can differ from the actual rejection-decision or receipt date. The official file record must be checked.
Immediate narrowing before diagnosis
Amendment can be necessary, but automatic narrowing may surrender value before the examiner's reasoning has been tested.
Undefined “no win, no fee” terms
If “win,” fee triggers, exclusions, official costs, and stopping conditions are not written, the apparent risk-sharing model may create a later dispute.
