China Patent Office Action Response Support

A China patent second opinion for difficult CNIPA prosecution.

Fixer IP helps foreign counsel prepare responses to difficult Chinese patent office actions. We analyze the examiner's reasoning, map the cited prior art, test claim amendments against the original disclosure, and develop a response strategy for your review. Your firm keeps control of the client relationship, legal advice and filing instructions.

STAGE: CNIPA EXAMINATION FOCUS: DIFFICULT TECHNICAL OBJECTIONS MODEL: BEHIND-THE-FIRM SUPPORT

Office action or rejection decision?

The document determines the response route.

A CNIPA office action raising objections during examination is not the same as a decision rejecting the application. Articles 37 and 38 of the Chinese Patent Law distinguish the opportunity to respond or amend from the subsequent rejection decision. Start with the actual document and official deadline, not a database label or an informal translation of “rejection”.

If a rejection decision has already been received, see our China patent reexamination and rejection appeal service. Article 41 provides a three-month reexamination period measured from receipt of that decision. That is not a universal response period for every office action.

Where a fresh analysis can help

Responding to CNIPA inventive-step objections.

If your team describes the issue as a “China patent obviousness rejection”, start with the actual CNIPA reasoning and the inventiveness requirement in Article 22 of the Chinese Patent Law. A response should explain the claimed technical contribution and address the cited art; simply translating a response prepared for another patent office may leave the Chinese examiner's specific objections unanswered.

Inventive-step objections

Reconstruct the examiner's starting point, distinguishing features, technical problem and combination reasoning. Test whether the cited documents actually support the proposed route to the invention.

Misread technical features

Check whether similarly named components perform different functions or operate under different conditions. Build the explanation from the claims, description and references, rather than labels alone.

China patent claim amendment strategy

Compare argument-only and amendment routes. Identify disclosure support and the commercial scope lost by each proposed limitation. Article 33's original-disclosure boundary must be respected.

Later-stage prosecution

Review what earlier responses did and did not resolve. Explain whether a new argument changes the technical analysis or merely restates a position the examiner has already rejected.

Where the examiner relies on “common general knowledge”, our review identifies the precise assertion, the material cited for it and its role in the proposed combination. We test the reasoning in the context of the claim as a whole, including how the features interact and which technical effect the original application supports. These are file-review questions, not a promise that every common-knowledge objection can be overcome.

An additional review, not an automatic change of agent

When is a China patent second opinion useful?

A second opinion can help when a later office action repeats an unresolved objection, a proposed amendment would remove the feature that matters commercially, or the team needs to decide whether another response has a defensible technical basis. We compare the current claims, cited references and earlier responses before recommending a route.

The agreed review can be limited to a disputed issue or cover the response strategy. The output should show what changes the analysis, what evidence is missing and what scope each amendment would surrender. Your existing Chinese agent can remain the agent of record; your firm decides whether to use the work and authorizes any coordination. For a decision that already rejects the application, use our post-rejection second-opinion review.

Illustrative example — not a reported case

The same word can hide a different technical function.

Suppose a claim uses a sensor signal to adjust an actuator, while the cited reference uses its sensor only to issue a warning. Simply arguing that both systems are “different” is unlikely to explain the claim's contribution. A useful response maps the signal path, control relationship and disclosed effect, then asks whether the examiner's combination supplies the missing relationship. Any amendment must remain supported by the original application.

This hypothetical illustrates the method, not a prediction of allowance. For examples of our published, partially sanitized work, see the CNIPA zero-amendment grant case study and the separate post-rejection reexamination case library.

Review-ready work product

What your team can ask us to prepare.

The agreed scope may include the following. A scoped strategy review is not automatically a complete filing service.

Technical diagnosis and response architecture

A claim-to-reference comparison, the central disputed assumptions, an argument structure and the evidence needed to support it. Weak points and unresolved questions remain visible for responsible counsel.

Amendment options and drafting support

Alternative claim routes with disclosure support, scope trade-offs and proposed response language. Your team decides what to use or adapt; final legal judgment and filing remain with responsible counsel.

Start with a redacted file

What to send for an initial CNIPA office action review.

Do not send unpublished client-identifying records through the public form. Full files can be exchanged after confidentiality arrangements and conflict clearance. We do not contact your client unless expressly instructed. Formal China-side work may be handled through the licensed China-side structure identified on this site, subject to written engagement.

Practical questions

Before starting a response.

Can we keep our current Chinese filing agent?

Yes. Behind-the-firm technical and strategy support can be prepared for your team's review without replacing the agent of record. Coordination with another agent requires authorization.

Can you promise grant without narrowing the claims?

No. We can assess whether an argument-only route is supported and explain amendment alternatives, but cannot guarantee grant, retained claim scope or the examiner's response.

What are the fees and turnaround?

These depend on the record, technology, deadline and requested deliverables. Scope, fees and timing must be confirmed in writing before work begins. Official fees, translation and third-party charges are separate unless expressly included.
