China Patent Infringement and Disputes

A patent dispute may require separate answers to several questions: what the claims cover, what the product or process actually does, what prior art exists, and which evidence is available. We help rights holders, accused parties and their counsel assess these issues and plan a response.

Map the claims and evidence

We can compare relevant claim limitations with available product or process evidence, identify uncertainties in interpretation and missing evidence, and review the patent’s status and relevant file history. An infringement assessment requires the applicable legal framework and facts; a feature chart alone is not a final finding.

Consider validity separately

We can assess prior-art leads and the grounds and evidence for a possible invalidity strategy. Infringement and validity are distinct questions: a non-infringement position does not by itself establish invalidity, and a validity challenge does not by itself settle infringement.

From warning letter to dispute strategy

Depending on the agreed scope, work may include reviewing or preparing a warning-letter response, evaluating evidence preservation, coordinating invalidity and enforcement strategy, and considering negotiation, licensing or litigation. Formal representation, responsible practitioners, authority and applicable requirements are confirmed for the particular engagement.

Possible deliverables

A scoped project may produce a patent and status checklist, a claim-to-product comparison, an evidence-gap list, a prior-art and validity issues memorandum, or a written assessment of options and next steps. These examples describe possible work products, not completed client matters or promised results.

Before sharing documents

Begin with a neutral summary, patent number if public, product or process at issue, procedural stage and any known deadline. Avoid sending unpublished or client-identifying materials through the public form before confidentiality arrangements and conflict checks. Scope, fees and responsibilities are agreed before work proceeds.
